Terms of Use for JobVid.com

1.  BASIC OUTLINE AND OVERVIEW OF THE TERMS OF USE

This document is an Agreement that includes all of the Terms and Conditions that apply between you (Service providers, people looking to hire Service providers, or anyone else using the site for any reason) and JobVid.com .  This Agreement directs and presides over the use of any and all of the services offered at the JobVid.com Website.  From here forth, the “Website” will be synonymous with JobVid.com.  It is essential and mandatory that you read this agreement before using any of the services, features, search tools, or any other information (the “Services”) found on JobVid.com (the “Website”).  If you use the “Website” for any purpose, you are agreeing to the Terms of Use regardless of which features you access while on the “Website” and regardless of whether or not you sign-up for the membership offered by the “Website.”  From here forth, workers who have created a profile on JobVid.com, regardless of whether or not the profile is complete with information or incomplete) will be known as “JobVid.com Members.”  Prior to attempting to join JobVid.com and becoming one of the “JobVid.com Members,” it is mandatory that you read this Terms of Use document in its entirety.  By using any feature or information found on the “Website,” all users consent to, agree to, understand, embody, represent, warrant, respect, adhere to, and accept all of the terms and conditions that are contained within this Terms of Use document.  If you do not agree with anything you read in this document or object to anything found in this document, do not use the “Website” or any of the “Services” found on or provided by the “Website.”  The Terms of Use found on this page are subject to change by JobVid.com at any point in time and the new terms will immediately go into effect upon being posted on the “Website.”  If the Terms of Use change at any point in time and you continue to use the “Website” or the “Services” after the changes have been made, you consent to, agree to, understand, embody, represent, warrant, respect, adhere to, and accept all of new terms and conditions found in the new Terms of Use document.

 

2.  AGREEING AND ACCEPTING THE TERMS OF USE AGREEMENT THAT IS FOUND IN AND/OR COMPOSED OF THIS DOCUMENT. 

This Terms of Use document is a contact, specifically an electronic contract, that explains and describes the legally binding terms that will govern your use of the “Website” and the “Services” found on or found through the “Website.”  At any point in time, this Terms of Use document can be changed by JobVid.com and any such changes will become effective immediately at the time the new document is posted by JobVid.com.  The privacy policy found on JobVid.com is included in the Terms of Use agreement.  If you enter, access, use, or view any of the “Services” found on the “Website” or join the site and become one of the “JobVid.com Members,” you consent to, agree to, understand, embody, represent, warrant, respect, adhere to, and accept all of the terms and conditions found within or referenced by this Terms of Use agreement.  Additionally, if you enter, access, use, or view any of the “Services” found on the “Website” or join the site and become one of the “JobVid.com Members,” you consent to, agree to, understand, embody, represent, warrant, respect, adhere to, and accept all of the notices found within or referenced by this Terms of Use agreement.  Also, by using or accessing any of the “Services” offered by the “Website” or through being a member of the “JobVid.com Members,” you are giving your complete permission, approval, and consent to have the Terms of Service agreement presented to you in an electronic format (electronic form). 

 

3.  JOBVID.COM IS AN ONLINE PLACE WHERE WORKERS CAN COMMUNICATE WITH OTHER WORKERS AND PEOPLE LOOKING TO HIRE WORKERS

JobVid.com is a website that acts as a bulletin board where workers and/or companies from a number of different job categories can contact and be contacted by people and/or companies who are looking to hire people in any job category.  JobVid.com is best described as a venue.  From here forth, we will refer to people and/or companies looking to hire workers as “Worker Seekers.”  Additionally, from here forth, we will refer to people and/or looking to provide services or products as “Workers.”  JobVid.com does not participate in the communication, interaction, or discussion that occurs between “Workers” and “Worker Seekers.”  Users of JobVid.com understand, accept, specifically agree, and represent that JobVid.com does not and cannot have any control over any aspect of the service received from workers or companies found on or through the “Website.”  Specifically, users understand, accept, agree, and represent that JobVid.com cannot control or direct the quality, temporality, timing, thoroughness, legality, effectiveness, or any other attribute of any service or product obtain from or performed/made by any of the “Workers” or “Worker Seekers” found on or through the “Website.”  Also, users understand, accept, specifically agree, and represent that JobVid.com cannot control or affect the honesty, sincerity, authenticity, or any of the actions of the “Workers” found on the “Website.”  Users of JobVid.com further understand, accept, specifically agree, and represent that JobVid.com cannot control the quality, temporality, timing, thoroughness, legality, effectivenss, sincerity, authenticity, or any of the actions of the “Worker Seekers” found on or through the “Website”.  In no way does JobVid.com endorse, recommend, or represent any of the “Workers” or “Worker Seekers” found on or through the “Website” and/or the “Services” and JobVid.com does not make any claims or take any responsibility for any of the accuracy, completeness, proficiency, quality, or satisfaction with the services provided by either “Workers” or “Worker Seekers” regardless of whether interaction takes place online, offline, in public, in private, or directly through the “Website.”  It should be expressly noted that JobVid.com does not take on or assume any liability that may occur through the use of the “Website” or the “Services.”  Additionally, JobVid.com does not take on any responsibility or make any claims that the found on the “Website” or the “Services” is accurate, reliable, honest, or truthful.  In no way is JobVid.com to be held accountable for any actions of “Workers” or “Worker Seekers” that occurs either online or offline.  Any user of the “Website” or the “Services” agrees not to hold JobVid.com responsible for any incident, issue, problem, confrontation, or discrepancy with either the “Workers” or the “Worker Seekers.”  Additionally, any user of the “Website” or the “Services” specifically agrees not to hold anyone associated with JobVid.com under the categories owner, director, founder, CEO, investor, advisor, or partner liable for any incident, issue, problem, confrontation, or discrepancy with either the “Workers” or the “Worker Seekers” found on or through the “Website.”  Using any of the “Services” found on the “Website” or contacting any of the “Workers” or “Worker Seekers” implies and constitutes agreement to the statement that JobVid.com will in no way assume any liability at all for any sort of damage, lawsuits, claims, legal issues, concerns, or dilemmas that may arise secondary to the use of any of the “Services” found on and/or through JobVid.com.  JobVid cannot anticipate the actions and behaviors of any of the “Workers” or “Worker Seekers” and expect that all people who choose to meet with, communicate with, or do business with any of the “Workers” or “Worker Seekers” do their own due diligence in terms of checking into personal references and other background information.  JobVid.com also advocates prudence in always choosing a safe location in which to meet with one of the “Workers” or “Worker Seekers” found through or on the “Services.”        

    

4.  ELIGIBILITY

You must be at least 13 years of age to use any of the “Services” provided on the “Website” including the need to be 13 years old in order create a “Workers” profile (which is actually included as part of the “Services”).  The “Services” offered by JobVid.com are void where prohibited.  The “Services” offered by the “Website” are only to be used by people who are capable of entering a binding contractual agreement.  The “Services” offered by the “Website” may only be used by individuals who are legally able to work in the jurisdiction of the United States.  This site should not be used by anyone who has been convicted of a sexual offense or any other felony.  If a users does misrepresent his or her personal information or job specific information, including but not limited to number of years of experience, age, gender, location, criminal background, prior felonies, prior sexual offenses, or eligibility for employment in the jurisdiction of the United States, JobVid.com will not be held liable or responsible in any way for the misrepresentation or misstatements.  A user’s profile may be deleted and his or her membership terminated at any point without warning if JobVid.com believes the user to be falsifying information found within the user’s profile, job opportunity post, or any other area of the site that contains the user’s information.  Even more specifically, if JobVid.com has reason to believe that a user is under the age of 13, the user’s profile may immediately be deleted without warning.  Additionally, if JobVid.com has reason to believe that a user is over the age of 18, but has listed his or her age as under 18, the user’s profile may be deleted without warning.   Even following the termination of a user’s membership to JobVid.com, this agreement will still hold as a binding contract between the user and JobVid.com. 

 

5.  REGARDING INFORMATION AND LINKS POSTED BY SITE USERS

By using the “Website” and/or its “Services”, users agree that they will be the sole user of their “Workers” profiles.  Additionally, users of the “Website” and/or its “Services” agree that they will be the authorized user of their “Worker’s” profiles.  Users of the “Website” and/or its “Services” agree that they are responsible for ensuring that they are in fact the sole and authorized user of their profiles and that no other individuals have access to their “Workers” profile account or Job Opportunity posts.  If a user is concerned that another individual may have access to the user’s account, the user agrees to immediately contact JobVid.com and report the concern.  Any links that users find while using the “Website” or its “Services” are not supplied, endorsed, or approved by JobVid.com and should only be followed (in the case of hyperlinks or links that must be copy and pasted in the browser address bar) at the discretion of user.  JobVid.com does not in any way endorse, support, or vouch for any of the information contained on sites that users link to from JobVid.com.  Additionally, user should know that clicking or following any links that lead away from JobVid.com have the potential to send viruses, Trojan horses, worms, and other malicious material to the user’s computer.   Also, users acknowledge that JobVid.com’s Terms of Use policy does not apply to the sites accessed through links found on JobVid.com.  All users who use the “Website” and/or the “Services” agree not to hold JobVid.com liable, and to hold JobVid.com harmless from any liability, that may be a result of following a link found on the “Website.”

 

6.  INFORMATION POSTED BY JOBVID.COM USERS

Any and all users of JobVid.com who create or have a profile as a “Worker” or create a Job Opportunity post as a “Worker Seeker” agree that they will post completely accurate information including but not limited to their age, gender, level of experience, location, skills, abilities, licensure information, insurance information, and all other job-related information.  Additionally, all users of JobVid.com who create or have a profile as a “Worker” agree that their Job Specific Photographs and/or Profile Picture show their own work and are not copyrighted by another individual unless the user has the written permission of the owner of copyrighted material to upload and display the material on JobVid.com.  Addtionallly, even if a user has permission to upload and display copyrighted material, this material may only be displayed if the material shows the actual user’s work and accurately represents the user’s current level of skill and competency.  Also, if a user uploads a photograph of himself or herself to use as a Profile Picture or within the Job Specific Photographs section, the user agrees that the photograph accurately depicts himself or herself and is a recent photograph.  Under no circumstances may a user upload a photograph of an individual other then himself or herself for use as a Profile Picture.  Profiles that do not follow these guidelines for uploading photographs may be removed by JobVid.com without warning.  If a user decides to upload a video to his or her profile, the user agrees that the video will show the actual user’s work and also accurately represent the user’s current level of skill and competency.  Additionally, the user is forbidden from misrepresenting himself or herself in the video in terms of name, age, experience, skill sets, and any other relevant information.  None of the information a user adds to a profile or a Job Opportunity post may be false, misleading, or inaccurate.  If a user has entered information incorrect by accident, the information must immediately be changed so that it is accurate and correct.  Users are expressly prohibited from adding anything to their profiles or Job Opportunity posts that is copyrighted, trademarked, or patented by a third party.  Additionally, users may not uploaded trade secrets to their profile or Job Opportunity posts.  None of the material found on a user’s profile or Job Opportunity post may violate any law, statute, regulation, or ordinance.  Users are forbidden from including any information in their profile or Job Opportunity posts that is defamatory, libelous, threatening, harassing.  .  Users are forbidden from including any information in their profile or Job Opportunity posts that is pornographic or excessively violent in nature.  Users are forbidden from including any information in their profile or Job Opportunity posts that may lead to site visitors contracting viruses, worms, Trojan horses, or other malicious files/data.  Users are forbidden from including any information in their profile or Job Opportunity posts that will jeopardize JobVid.com or create liability for JobVid.com.  Only to allow JobVid.com to display users’ information on the “Website,” users agree to give JobVid.com a non-exclusive, world-wide, ongoing, royalty-free, right to exercise any rights and copyrights you have on information posted on JobVid.com in any media that is currently in existence or may come into existence in the future.  Site users should be confident that JobVid.com will only utilize user information for purpose outlined in this document, the Terms of User policy.

 

7.  COMPLIANCE TO THE CHILDREN’S ONLINE PRIVACY PROTECTION ACT

JobVid.com takes adherence to the COPPA very serious.  To use the site, you, the user, must be at least 13 years of age.  As stated above, if JobVid.com has reason to believe that a user is under the age of 13, that user’s profile may be deleted without warning.  To ensure adherence to the COPPA, you must enter your age when creating a “Workers” profile or post a Job Opportunity.  JobVid.com will not be held liable in any way for any misrepresentation of age that occurs by any of the users of the “Website” both during the process of creating a “Workers” profile and/or the process of creating a Job Opportunity post.

 

 

8.  RELEASE

JobVid.com does not participate in the actual contact between “Workers” and “Work Seekers” and users of the “Website” therefore agree that JobVid.com and its directors, officers, employees, agents, investors, licensors, attorneys, independent contractors, providers, subsidiaries, and affiliates will be released from any disputes, claims, lawsuits, damages, or demands of all and any kinds and nature, whether they are known or not know, whether they are actual or consequential, whether they are suspected or unsuspected, whether they are disclosed or undisclosed, that may be the result of or involving a dispute and/or disagreement between “Workers” and “Work Seekers.”

 

 

9.  PREVENTION OF SOLICITATION

JobVid.com users are forbidden from contacting “Workers” or “Worker Seekers” with the intent to have them join another service, online or offline, or for any other commercial reasons.  If JobVid suspects that a user is contacting “Workers” for reasons other then to learn about their qualifications and skills or to hire them, the user’s membership with JobVid may be terminated without warning.      

 

10.  PROHIBITION OF INFORMATION MINING OR INAPPROPRIATE USE OF WORKER INFORMATION

Users of JobVid.com are strictly forbidden to contact “Workers” or “Work Seekers” for any reason besides procuring employment.  JobVid.com is not a dating site and users are forbidden to contact users for casual conversation.  If a user finds that he or she is being contacted by another individual for reasons unrelated to the procuring employment, the user should report the incident(s) to JobVid.com.  Users are expressly prohibited from collecting many email addresses from JobVid.com and then emailing all users at once.  JobVid.com may prevent a user from continuing to contact “Workers” or “Worker Seekers” if JobVid.com feels that the user is sending too many emails to one or multiple “Workers” or “Worker Seekers” on the “Website.”  Users have access to JobVid.com at the discretion of JobVid.com and the “Website” may block access to users at its sole discretion at any time deemed necessary.

 

11.  INDEMNIFICATION

By using this “Website” and therefore agreeing to the Terms of Use, users of the Site agree to indemnify, defend and hold harmless JobVid.com, its directors, officers, employees, agents, investors, licensors, attorneys, independent contractors, providers, subsidiaries, and affiliates (collectively referred to herein as "JobVid.com and Affiliates") from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred by JobVid.com and Affiliates in connection with any claim by a third party (including an intellectual property claim) arising out of (i) materials and content you submit, post or transmit through the Site, or (ii) use of the Site by you in violation of these Terms of Use or in violation of any applicable law. Users further agree that they will cooperate as reasonably required in the defense of such claims. JobVid.com and Affiliates reserve the right, at their own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by users, and users shall not, in any event, settle any claim or matter without the written consent of JobVid.com. Users further agree to hold harmless JobVid.com and Affiliates from any claim arising from a third party's use of information or materials of any kind that users post to the Site.

 

12.  JOBVID.COM SUBSCRIPTION COSTS

JobVid.com is currently a completely free service for “Workers” and “Worker Seekers.”  JobVid.com reserves the right to charge users for any of the "Services" offered on the“Website” in the future at a time that is completely at the discretion of JobVid.com.  Users will be notified if JobVid.com decides to begin charging for the “Services” and no user will be charged without agreeing to such charges.

 

13.  JOBVID.COM’S RIGHTS TO ALL TEXT, GRAPHICS, VIDEOS, ETC.

JobVid.com either has permission or a copyright for all material displayed on the “Website” including but not limited to text, graphics, HTML, videos, photographs, images, schedules, email addresses, layouts, general feel of the site, and flow from one page to the next.  None of this material may be used without the express written consent of JobVid.com unless the material belongs to the particular user seeking to use the material (as in the case of a user’s video or photographs). 

 

14.  NO WARRANTY

JOBVID.COM IS NOT RESPONSIBLE FOR ENSURING THAT THE MATERIAL ON THE SITE IS ALWAYS ACCESSIBLE AND UNINTERRUPTED.  USERS EXPRESSLY AGREE THAT USING JOBVID.COM IS AT THE SOLE DISCRETION AND RISK OF THE USER.  JOBVID.COM IS NOT RESPONSIBLE FOR THE ACCURACY, CORRECTNESS, RELIABILITY, JUDGEMENT, OR CONTENT OF ANY OF THE MATERIAL FOUND ON THE WEBSITE.  JOBVID.COM IS NOT RESPONSIBLE FOR ANY INTERACTION BETWEEN WORKERS AND WORKER SEEKERS THAT MAY OCCUR EITHER ONLINE OR OFFLINE.  THE INFORMATION ON JOBVID.COM IS PROVIDED TO THE GENERAL PUBLIC ON AN “AS IS” BASIS AND WIHOUT ANY WARRANTIES, REGARDLESS OF THE NATURE OF THE WARRANTY.  JOBVID.COM IS NOT RESPONSIBLE FOR ANY CONSEQUENCES OR RESULTS THAT MAY RESULT DUE TO THE USE OF THE SERVICE OR SITE CONTENT.  JOBVID.COM IS NOT ABLE TO GUARANTEE THAT THE WEBSITE IS FREE OF VIRUS, TROJAN HORSES, WORMS, OR OTHER MALICIOUS MATERIAL.  JOBVID.COM CANNOT GUARANTEE THAT INFORMATION PROVIDED BY USERS WILL NOT BE SEEN AND/OR OBTAINED BY OTHERS WHO ILLEGALLY OR INAPPROPRIATELY GAIN ACCESS TO THE SITE’S DATABASE OR INTERCEPT INFORMATION WHILE IT IS BEING TRANSFERRED TO JOBVID.COM.  ADDITIONALLY, JOBVID.COM CANNOT GUARANTEE THAT USER’S INFORMATION WILL NOT BE  DESTROYED OR REMOVED BY OTHERS WHO GAIN ACCESS TO JOBVID.COM’S DATABASE.  JOBVID.COM AND IT’S DIRECTOR, OFFICERS, EMPLOYESS, AGENTS, INVESTORS, ATTORNEYS, INDEPENDENT CONTRACTORS, PROVIDERS, SUBSIDIARIES, AND AFFILIATES WILL NOT BE HELD LIABLE FOR ANY DAMAGE, LAW SUITS, CLAIMS, OR INJURY SUSTAINED OR ARRISING FROM OR THROUGH THE USE OF JOBVID.COM.

 

15.  CANCELLATION:

You may cancel your membership at any point by following these steps:

1) Go to the Sign In page by clicking the Sign In button found at the top of any page on the site.

2) Enter your username and password.

3) Click on "Edit Profile"

4) Click on "Delete Profile"

5) Confirm the profile deletion

Please note that there is no cost to cancel your membership.

 

16.  JURISDICTION

You expressly agree that exclusive jurisdiction for any dispute with JobVid.com, or in any way relating to your use of the JobVid.com, resides in the courts of the State of Massachusetts and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Massachusetts in connection with any such dispute including any claim involving JobVid.com or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.

 

17.  MISCELLANEOUS 

Nothing found in this Terms of Use Agreement shall be construed as making either party the partner, joint venturer, agent, legal representative, employer, contractor or employee of the other. Neither party shall have, or hold itself out to any third party as having, any authority to make any statements, representations or commitments of any kind, or to take any action, that shall be binding on the other, except as provided for herein or authorized in writing by the party to be bound. This Agreement will be binding on and will inure to the benefit of the legal representatives, successors and assigns of the parties hereto.

 

18.  COPYRIGHT CONCERNS

If there is any concern that information, graphics, or video found on this site is copyrighted and being used without permission, contact David.Glazier@tufts.edu.  Provide a detailed explanation of the material that is infringing on your copyright and where on the site the material is located.  Any material found to be on the site that is used without appropriate permission will be removed.
